WHAT IS CONVEYANCING?

A typical conveyancing transaction contains two major landmarks: the exchange of contracts (this is where equitable title passes) and completion (this is where legal title passes).

WHAT IS A SECTION 32 STATEMENT AND WHY IS IT IMPORTANT?
A Section 32 Statement basically details all the ‘fine print’ about a land or property that impacts safety, value, finance, etc.
For example, if existing owners have not paid their council rates and have a large outstanding bill, this will be in the Section 32. It’s important to check this because once the title transfer is completed, this bill would become your responsibility.
There are many other important details in a Section 32 and your conveyancer will read over this statement closely to make sure you are buying land or property that is worth it’s price with minimal restrictions and no encumbrances. Your conveyancer will give you a report so you can decide if you want to proceed with purchasing the land or property, it can also help you determine the value of your offer.
